Client Agreement - Cuddling Comfort Lounge

In order to be properly registered with Cuddling Comfort Lounge, (a.k.a.CCL), all prospective clients must carefully read this form. This policy applies to both male and female clients. All Clients must be over the age of 19 to access CCL’s services.

1. Policy Statement:

Cuddling Comfort Lounge, a.k.a. CCL is a PLATONIC therapeutic cuddling service agency. Its purpose is to provide professional services by trained and certified cuddlers to the community, in a mutually safe and comfortable non-judgemental environment. Both parties must give and receive respect and consent during the Cuddling session. Therefore, absolutely no sexual activity or nudity is permitted under any circumstance before, during or after a cuddling session with the Cuddler.

2. Definition of Sexual Activity:

Forcing or pressuring the cuddler into a sexual activity, constitutes sexual assault. Sexual activity includes, but is not limited to kissing, dry humping, hips movements back and forth, fellatio, masturbation, sucking fingers or toes, getting voluntarily aroused, touching forbidden places (areas covered by undergarments) or taking cuddling positions with a sexual connotation and/or penetration.

3. Serious Offenses:

If the Client commits a serious offense, the cuddler will leave or ask the client to leave immediately. The client will be placed on the CCL’s banned list and there will be no refunds. In cases of sexual assault, the client will be reported to the police.

Serious offenses are defined as follows:

Committing a sexual assault;
Intentionally touching areas of the body covered by undergarments, knowing that it is forbidden;
Kissing the cuddler on the mouth;
Being under the influence of alcohol or drugs;
Deliberately exposing body areas normally covered by undergarments. Both parties will remain clothed during the entire session. If either party needs to change clothing, this will be done in private & out of sight of the other party.

4. Prohibited Behavior:

If a client has mild prohibited behavior, up to two warnings will be given to the client. If the incident occurs on the third time, the cuddler will leave or will ask the client to leave.

If the Cuddler has to leave or requests the Client to leave, the Client will be placed on CCL’s banned list and their membership will be terminated. There will be no refund.

Related prohibited behavior offenses are described as follows:

Getting voluntarily aroused – (for example with hips movements);
Touching gently or ‘inadvertently’ areas covered by undergarments
Kissing the cuddler on the mouth;
Proposing sexual activities;
Asking the cuddler out on a date outside the cuddling session would constitute companionship and cannot be arranged with the cuddler, but with CCL exclusively.
Calling or texting a cuddler without consent from CCL.

5. Safety:

The Client must show a piece of I.D. at the beginning of the session. The Cuddler will take a picture of it and send it electronically to the CCL head office. It will be compared to the photo ID that Client submitted upon registration. If they match, the session will proceed, if they do not match, the session will be canceled. There will be no refund, and the clients membership will be revoked.
Cuddlers will contact the head office after appointments with their personal code to confirm they have left safely if the session is at the Client’s location.
The Cuddle session may be recorded on video only (no sound) when the cuddler and the Cuddlee’s session are at the head office. This is in order to protect Cuddlers and Clients from any allegations of misconduct.
The client agrees to fully disclose to the practitioner any diagnoses or medical conditions that may affect their session.

6. Booking a Cuddler:

You can book a cuddler online through our website in our booking page. Please forward any booking issues to: reservations@cuddlingcomfortlounge.com ;
If a Cuddler is unavailable for a selected booking, the Client may choose to reschedule another time or keep the same time, but with another Cuddler;

7. Payment:

The Client must pay the fee at the time of booking, at least 5 days prior to the cuddling session, through CCL’s website.

If the Client wishes to have additional time, they may request an additional hour or hours, if the Cuddler wishes to continue. The Client must book and pay for the additional time before the second session can begin.
The Client may never pay the fee to the Cuddler directly.
After the session, the Client may offer a gratuity to the Cuddler for exceptional service, at the Client’s discretion.

8. Discounts:

Clients are entitled to discounts offered through their memberships if the booking is made in advance. At least 72 hours notice is required for extension of the cuddling session.
Discounts will not be honored for short notice extensions.

9. Hosting:

The Client may host a Cuddler at his or her home or the Cuddler may host at their home depending on the convenience of both parties.

The Cuddler will be informed of the Client’s preference;
The Client must offer the Cuddler a clean and safe space for the session and exercise Duty of Care while at their location.
If neither Cuddler or client can host, it will be the client’s responsibility to rent space in a hotel, motel or another form of accommodation at the client’s expense.
You or the Cuddler may end the session at any time.

10. Confidentiality:

The Cuddler will keep all information about the Client, their filmed session and what the Client disclosed as confidential. CCL encourages the recording of sessions, in order to work together, to avoid potential legal issues. The recordings are strictly confidential and will only be shared with the appropriate authorities in case of a criminal breach. These video recordings are all encrypted properly and they are deleted thirty business later (to allow time in case any complaints arise). The Client may not secretly videotape the session when hosting a Cuddler.

The filmed sessions are transferred on a separate hard drive. They are not put up on the internet. Confidentiality will only be breached if a crime has been committed. In this case, the information would be released only to the appropriate authorities.

11. Reporting:

The Client agrees to report the Cuddler who does not respect the professional cuddler’s Code of Conduct. The Client will report if the Cuddler lacked professionalism such as: late arrival, not wearing the CCL T-Shirt or no-show, inciting for sex or inappropriate touching. The Client will report a Cuddler if their personal hygiene is less than desirable or smells strongly.

12. Hygiene:

Cleanliness and adequate hygiene are required by both parties. This specifically includes showering/teeth brushed within 12 hours of the appointment, wearing freshly laundered clothing, and no (or minimal) perfume/cologne be worn by either party unless requested. The cuddler may leave if the Client’s smell is too strong for them. The Client with the bad hygiene will not be refunded for the session time. If the Cuddler has bad hygiene, the session will end and the Client will be fully compensated.

13. Cancellation:

Cancellation within 8 hours of a session will result in 50% charge of the session.

Cancellation within 3 hours of a session will result in 100% charge of the session, unless due to urgent or unforeseen circumstances such as an accident. The client must provide proof thereof. Discounts will not be honored for cancellations. In a case where proof is provided, the client may book another session with a Cuddler.

14. Waiver:

The client agrees hereby to indemnify and hold CCL harmless from any and all claims by the client which may arise out of and in the course of their session. The client releases CCL from any liability.

15. Legality:

The Cuddler and the Client will not break any federal, provincial laws or municipal by-laws, statutes or regulations before, during or after their session.

16. Arbitraction clause:

If any dispute arises between the Parties relating to the application, interpretation, implementation or validity of this agreement between the client and the cuddler, the Parties agree to resolve the dispute by arbitration using the ADR Chambers Expedited Arbitration Rules. The arbitration shall be held in the province where the service took place and shall proceed in accordance with the provisions of the Arbitration Act of the said province. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
